Terms of Service
These Terms and Conditions ("Terms") govern your participation in services provided by Midnight Phoenix Wellness, operated under Midnight Phoenix LLC ("we," "our," or "us"). By booking, purchasing, or participating in any of our services (virtual or in-person), you agree to the following terms:
1. Services Provided Midnight Phoenix Wellness offers wellness services including, but not limited to, virtual and in-home guided meditation, breathwork, beginner yoga sessions, group classes, and private consultations. Services may expand to include additional wellness modalities.
2. Eligibility Participants must be 18 years of age or older or have written parental/guardian consent. Services are not a substitute for medical care or therapy.
3. Health Disclaimer You acknowledge that our services involve physical and mental exercises that may carry risk. You affirm that you are responsible for your own health and have consulted a medical professional if you have any concerns. You agree to disclose any relevant medical conditions prior to participation.
4. Booking and Payment All services must be booked in advance through our website or by direct contact. Payment is due at the time of booking. We accept credit/debit cards and other secure payment methods as provided on our platform.
5. Cancellation and Rescheduling Policy
Appointments must be canceled or rescheduled at least 24 hours in advance.
Cancellations made less than 24 hours before the scheduled session may be non-refundable.
No-shows are non-refundable.
For group classes, refunds will not be issued for missed sessions.
6. Memberships and Packages Memberships are recurring unless canceled at least 14 days before the next billing cycle. Packages must be used within the timeframe specified at purchase. Unused sessions may not be rolled over unless otherwise stated.
7. Refund Policy Refunds are issued at the discretion of Midnight Phoenix Wellness. We reserve the right to decline refund requests that fall outside of our stated policies.
8. Conduct and Safety We reserve the right to terminate services for individuals who display disrespectful, unsafe, or inappropriate behavior. All participants must respect the instructor and other participants during group classes.
9. Liability Waiver By participating in our services, you release and hold harmless Midnight Phoenix LLC, its employees, and instructors from any and all claims, damages, or liabilities arising from or related to your participation.
10. Privacy and Confidentiality Your personal and health information will be kept confidential and used only for service provision. We do not share your data without consent, except as required by law.
11. Intellectual Property All content provided through Midnight Phoenix Wellness, including meditations, class recordings, written material, and branding, is the intellectual property of Midnight Phoenix LLC. You agree not to reproduce, distribute, or share such materials without permission.
12. Modifications We reserve the right to update or modify these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
